The Colorado constitution established the position of County Clerk in each county. The original duties of the County Clerk are to be the ex-officio recorder of deeds and clerk to the Board of County Commissioners. Many laws have changed in Colorado since 1876, which have defined and refined the role of the Clerk and Recorder.
Clerks across Colorado have a variety of roles in county government today, and not every county is the same. Ultimately, all Clerks oversee Elections, Recording, and Motor Vehicles (except Denver), and all Clerks are Clerk to the Board of County Commissioners of their respective government boards. In Fremont County, the Clerk and Recorder is the Chief Election Official, Designated Election Official, Coordinated Election Official, Registrar of Deeds, Agent of the State for Motor Vehicles, Agent of the State to issue Marriage and Civil Union Licenses, Clerk to the BoCC, and Liquor Licensing Agent.
The Clerk and Recorder is the custodian of the following records: Commissioner records and actions, filed records, real estate records, county oaths of office, defunct municipal actions and seals, county surveyor records, school bonds, election records, and more. Records that pertain to county finances, property improvement information, or taxes within the county, are in different offices or departments.
The Clerk and Recorder holds and protects the history of the county, as the custodian. In Fremont County, the Clerk's records start in 1861 and are current to the day. Custodians are charged with retention and preservation of any record given to the office. Records are either permanent retention or temporary retention, and as such, it is the duty of the Clerk to ensure they last through time.
